The Song Room (referred to as us or we) is a Company Limited by Guarantee registered in Australia (ABN: 68 790 325 760 and ACN: 159 071 584) and a Registered Charity with Deductible Gift Recipient (DGR) Item 1 and Tax Concession Charity (TCC) status. The organisation is located in Australia.

    1. In these Terms and Conditions of The Song Room Internet site (Site), we or us means The Song Room Limited.
    2. In these Terms and Conditions of the Site, you or your means users of The Song Room Site.
    3. Nothing you do on or in relation to the Site will transfer any copyright or intellectual property rights in the Content to you or licence you to exercise any intellectual property rights over the Content.
    4. You acknowledge that our corporate name “The Song Room” and logo are our trademarks. All rights in our trademarks are reserved by us. All other trademarks appearing on our Site are the property of their respective owners
    5. You acknowledge that you will not sell, reproduce, distribute, modify, display, publicly perform, prepare derivative works based on, repost or otherwise use any of the Content in any way for any other purpose without our prior written consent; or
    6. Otherwise infringe the intellectual property rights of any person in using the Site or any Content.
    1. We attempt to keep the Content of the Site up to date. However, we do not warrant the accuracy or currency of the Content.
    2. You acknowledge that the Content on the Site is liable to change at any time.
    1. In these Terms and Conditions, Applicable Law in relation to any person, action or thing means the following in relation to that person, action or thing:
      1. any law, rule or regulation of any country (or political sub-division of a country);
      2. any obligation under any licence in any country (or political sub-division of a country); and
      3. any lawful and binding determination, decision or direction of a regulator in any country (or political sub-division of a country).

      1. disrupt or interfere with the Site or servers or other software, hardware or equipment connected to or via the Site;
      2. violate any Applicable Law relating to your use of the Site; or
      3. collect or store personal data about other users of the Site.

We have not reviewed all of the sites, downloads, plug-ins, features or activities linked to this Site and are not responsible for the content or accuracy of any off-site pages or any other sites linked to this Site (including without limitation sites linked through any search engines). The inclusion of any link does not imply that we endorse the linked site, and you use the links you do so at your own risk. We do not accept any responsibility or liability for any claims arising out of your use of these links or of the descriptions or information supplied to us.
    2. Your correspondence or dealings with, or participation in activities on other sites linked to this Site, are solely between you and such other sites. We will not be liable or responsible for any loss or damage of any sort incurred by you as the result of any such dealings or as the result of the presence of links to other sites on the Site.

    1. Donation Services
      1. The Song Room will use your donation at the organisation’s discretion but within our stated charitable objectives.
    2. Privacy
      1. The Song Room will not share your personal details with any other third party other than is set out in our Privacy Policy.
    3. Regular Donations
      1. By confirming that you wish to proceed with a regular donation you authorise our payment service provider to request funds from your credit or debit card on the day of each month recurring from the first donation.To cancel your regular donation please contact us at enquiries@songroom.org.au.
    4. General
      1. We reserve the right to amend these Donation Payment Terms and Conditions at any time.
      2. If you make an error with your donation please contact us either by email at enquiries@songroom.org.au, by phone at (03) 9521 3990.
      3. If you become aware of fraudulent use of your card, or if it is lost or stolen, you must notify your card provider.
      4. All donations over $2 are tax deductible.
    Service Availability

    1. Every time you text 1999 7664, a $5 donation will be made and will appear on your mobile phone bill.
    2. This text donation service is available on eligible mobile telephone plans within Australia, with the exception of Optus Prepaid.
    3. Please keep the phone bill and text message as copy of your receipt.
    4. Optus, Vodafone & Telstra pass on 100 % of the donation.

    Use, Disclosure & Personal Information Security

    The Song Room would like to contact you in the future regarding your donation and The Song Room’s ongoing activities, campaigns and appeals that may be of interest to you. The Song Room is committed to safeguarding your Personal Information as detailed in our Privacy Policy. You can access The Song Room’s Privacy Policy on our website at any time. To find out how to change any information that may be held, enquire about how information is used, and learn about how The Song Room deals with complaints, of which we treat very seriously, please contact us.

    In some instances data may be stored and processed overseas by contracted Premium SMS service providers. Where this occurs, The Song Room takes reasonable steps to ensure that all data is handled in a manner that is consistent with the Australian Privacy Principles. Third party contractors currently provide a component of their services in Ireland, the United States and China. We do not rent, sell or exchange any information we hold.

    Donations of $2 or more are tax deductible.

    1. If any part of this agreement is held to be unenforceable, the unenforceable part must be given effect to the greatest extent possible and the remainder will remain in full force and effect.
    2. This agreement is governed by the laws of Victoria, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of Victoria, Australia.




Competition Terms and Conditions

  1. The promoter of this competition is The Song Room (ABN 68 790 325 760), Level 5, Building K, 32-50 St John Street, Prahran, Victoria, Australia.
  2. By entering the competition, you agree to be bound by these Terms and Conditions. Any instructions relating to the competition on the promoter’s website form part of these Terms and Conditions.
  3. The promoter may at its discretion refuse to award any prize to any entrant who fails to comply with these Terms and Conditions.
  4. By entering the competition you agree to be contacted by the promoter in regard to the work of the promoter and the competition.


  1. Entry to the competition is open to all residents of Australia.
  1. An entrant must be an individual and not a company or organisation. Employees of the promoter and any person associated with the competition, or directly with the provision of the prize(s), are not eligible to enter.
  2. If an entrant is under 18 years of age, they must get the permission of a parent or guardian before entering this competition.


  1. The competition opens at 8.00am AEST on Monday 5 September, 2016 and closes at 12pm Midday AEST on Monday 3 October, 2016.
  2. Any entry received after the expiry of the competition period will be deemed invalid.  No responsibility is accepted for late, lost, delayed or misdirected entries.


  1. To enter the competition, you must ‘like’ the ARTS:LIVE Facebook page found at https://www.facebook.com/artslive.ed/ and complete the online entry form.
  2. You must not enter the competition more than once.


  1. All prizes will be drawn at 12.00pm midday on Tuesday 18 October, 2016 at The Song Room, Level 5, Building K, 32-50 St John Street, Prahran, Victoria, Australia.

  1. Decisions of the promoter and its panel of judges are final and will be binding on each person who enters the competition and no correspondence will be entered into.
  2. Prize winners must comply with any third party terms and conditions relevant to the prize as applicable.
  3. The promoter shall not be responsible for any additional costs associated with use of the prize. The prize winner is responsible for all costs associated with using the prize.
  4. No component of the prize can be transferred or redeemed for cash.
  5. The promoter shall not be responsible for lost, stolen or damaged prizes once in the possession of the prize winner.


  1. The prize winners will be notified in writing by email at the end of the competition period. Please allow at least 30 days from the date of notification for the delivery of the prize.
  2. Winners will be published in writing at https://www.facebook.com/artslive.ed/
  1. You warrant that all details provided with your entry are true and accurate. Should details of the prize winner not be true and accurate the promoter reserves the right to redraw the prize.
  1. Unclaimed Prize Draw. Should any prize not be claimed within 3 calendar months of the prize draw, a redraw will be held for that/those particular prize/s. This draw will be held at The Song Room, Level 5, Building K, 32-50 St John Street, Prahran, Victoria, Australia on Monday 6 February, 2017 at 12.00pm midday. Winner/s will be notified in writing by email, and published in writing at playair.com.au.
  2. You agree that the promoter may use your personal details provided to the promoter for the purpose of conducting the competition.  The promoter may disclose your personal information to its contractors, agents, any co-promoter and to State and Territory gaming departments, to assist in conducting this competition. Prize winners’ names will be published as set out in these Terms and Conditions. The promoter may also use your personal information for any promotional, marketing and publicity purposes of the promoter, subject to the promoters Privacy Policy available at http://www.songroom.org.au/privacy-policy/.
  1. If there is any event that prevents or hinders the promoter’s conduct of the competition or the promoter’s ability to deliver the prize/s to the prize winner/s, the promoter may, in its discretion, cancel the competition and recommence it at another time under the same conditions or select another winner. Changes, modifications or suspension of the promotion is subject to relevant state and territory regulations.
  2. The promoter is not responsible for any incorrect or inaccurate information, or for any failure of the equipment associated with or utilised in this competition, or for any technical error that may occur in the course of the administration of this competition.
  3. To the full extent permitted by the law, the promoter will not be liable for any death, injury, damages, expenses, or loss whatsoever (whether direct or consequential) to persons or property as a result of any person entering into the competition or accepting or using any prize, including without limitation non-receipt of any prize or damage to any prize in transit and the prize winner’s failure to comply with the terms and conditions (if any) specified by any third party.
